We are delighted to have you on board and thank you for choosing Milna. By accessing and using Milna, you agree to comply with these Terms of Service (the "Terms"). These Terms outline the rules and guidelines that govern your use of the platform, ensuring that both you and Milna have a clear understanding of expectations and responsibilities.

We encourage you to take the time to carefully review these Terms to ensure that you fully understand how Milna operates and how your interactions with the platform will be governed. Your continued use of Milna constitutes your acceptance of these Terms, and we are committed to providing you with a positive and enjoyable experience as you use our services.

1. Introduction

1.1 Please carefully review the following provisions of these Terms and Conditions of Use ("Terms") to ensure you fully understand them before using our software programs and related documentation (the "App") or any services provided through the App (the "Services"). The App and Services together are referred to as the "Products."

1.2 You may only use the Products in accordance with these Terms and all applicable laws, rules, and regulations. By using the Products, you agree to enter into a binding contract with us. This agreement is made between you and Milna (“we,” “us,” or “our”). Your registration to use the Products constitutes your acceptance of these Terms. If you do not agree to these Terms or our Privacy Policy at any time, you must discontinue using the Products.

1.3 Our Products are continually evolving and may be modified at our discretion. We may, at any time, suspend or discontinue the Products, or any features thereof, either temporarily or permanently. Additionally, we reserve the right to impose limits on the use or storage of Products at our sole discretion. We may also remove or restrict the distribution or visibility of your Content, suspend or terminate user accounts, and reclaim usernames without liability. Certain Products or features may require a fee, and by purchasing or using such Products, you agree to any additional terms that apply.

1.4 To ensure that our services remain aligned with legal requirements, industry standards, and your evolving needs, we reserve the right to update, amend, or supplement these Terms at any time. Whenever these Terms are updated, we will notify you through appropriate means, such as within the app, via email, or by updating the "Last Revised" date at the top of this document. We encourage you to review these Terms periodically to stay informed of any changes. Your continued use of the services after any modifications to the Terms will constitute your acceptance of those changes. If you do not agree with the updated Terms, you may choose to stop using the services at any time.

2.Eligibility

2.1 You may only use the App and/or Services if you are at least eighteen (18) years old, have the legal capacity to enter into this Agreement, and are not prohibited by any applicable law from accessing the App or receiving the Services. If you are under 18, or if you have been convicted of a sex offense, involved in human trafficking or modern slavery, lack legal capacity, or are otherwise restricted by law from using the Products in your jurisdiction, you are not permitted to use the Products.

2.2 Any attempt to access, register for, or use the Products provided by Milna by individuals who do not meet the eligibility criteria outlined in these Terms is strictly unauthorized and in violation of the Terms of Service. If we determine that an individual has accessed or used the Products without meeting the necessary eligibility requirements, we reserve the right to take immediate action, including suspending or terminating their account. It is your responsibility to ensure that you meet the eligibility criteria before using the Products, and failure to do so may result in the loss of access or other consequences.

2.3 By using the Products, you represent and warrant that you possess the full legal authority and competency to enter into this agreement and to comply with all the terms and obligations set forth in these Terms of Service. Your use of the Products signifies your legal capacity to fully understand and adhere to all requirements set forth herein.

2.4 We reserve the right to suspend or terminate your account, remove any Content you have posted, and/or restrict your access to the Products (or any part of the Services) if we determine that you do not meet the eligibility requirements outlined above.

3.Opposition to Child Sexual Abuse Material (CSAM)

We have a strict zero-tolerance policy regarding Child Sexual Abuse Material (CSAM). The following actions are strictly prohibited on our platform:

Any user found to be involved in CSAM-related activities will have their account immediately deactivated, and we will notify the appropriate law enforcement authorities. We are fully committed to safeguarding the well-being of children and will take all necessary actions to prevent the spread of CSAM on our platform.

4.Prohibited Behavior

4.1 You are not allowed to:

Failure to comply with the Community Guidelines or these Terms may result in your account being suspended or deactivated. All users of the App are required to follow the community guidelines. This includes using only photos of yourself for your profile picture, never falsifying your age, and refraining from impersonating others or creating fake profiles in any way.

4.2 Your Content – Be Mindful of What You Share

You are fully responsible for any Content you upload, share, or display through the App or Services.

  1. By sharing or displaying Content through the App or Services, you grant us an unrestricted, non-exclusive, royalty-free global license to use, reproduce, distribute, transmit, display, or otherwise utilize that Content in connection with the App, Services, and promotion of our Products. You can revoke this license at any time by removing the Content, but this does not affect any prior use of the Content by us.
  2. You are prohibited from posting any personal or sensitive information (such as home addresses, phone numbers, email addresses, bank details, or URLs) on your profile or anywhere else within the App or Services, whether related to yourself or others. If you decide to share personal information directly with other users, you do so at your own risk.
  3. If you share Content that is protected by intellectual property rights, you affirm that you either own or have the necessary rights to share, display, or modify that Content. You are responsible for paying any royalties, fees, or other payments owed to third parties as a result of your Content.

  1. Failing to comply with the above rules may result in civil or criminal liability. In such cases, we reserve the right to immediately suspend or terminate your account and/or remove or disable access to any offending Content, either temporarily or permanently.

4.3 Other Users’ Content

Although this is not allowed under Our Terms, you understand and acknowledge that the Content, including but not limited to information regarding personal and physical appearance, transmitted, displayed or communicated by other users through the Products may be incorrect, misleading, or edited electronically in a manner that does not accurately represent such user’ actual information or physical appearance, or may violate your or third parties’ personal or intellectual property rights.

5. Your Data

5.1 We handle and store your data with the utmost care and in strict compliance with our Privacy Policy. Our Privacy Policy outlines the types of data we collect, how it is used, stored, and protected, as well as your rights regarding your personal information.

5.2 We will make reasonable efforts to retain your Content in connection with your use of the Products, ensuring that your data and materials are preserved securely for as long as necessary to provide the services you request. While we strive to maintain the availability of your Content, please note that there may be circumstances beyond our control, such as technical issues, legal requirements, or account deletion, that could result in the loss of your Content. We encourage you to keep backups of any important materials you upload or create through the Products. Our commitment is to handle your Content with care and to retain it for a reasonable period in accordance with our internal policies and the purposes for which the Products are used. However, we do not guarantee indefinite retention, and we may remove or delete Content in accordance with our data retention policies or when deemed necessary.

5.3 If you choose to provide comments, suggestions, or feedback about the Products ("Feedback") through the available submission channels or the “review” sections in the Application Stores, you grant us an exclusive, unrestricted license to use, modify, or distribute that Feedback for any purpose, including commercial use, without any obligation to compensate or attribute it to you or any other party. We are not required to keep any Feedback confidential. You also acknowledge that by providing Feedback, you do not gain any rights to the Products or any updates, changes, or modifications made to them. Furthermore, you are solely responsible for the content you submit, including its legality, accuracy, appropriateness, originality, and compliance with copyright laws.

6.Premium Services, Paid Content

Milna provides paid services to users, but it's important to understand that we don't directly receive or process any payments or credit card information. Instead, you have the option to purchase these paid services through your App Store or Google Play account, which we refer to as a "Third Party Account."

If you choose to purchase any paid services through your Third Party Account, the associated fees will be charged to your account. Please keep in mind that Milna does not have control over the terms and conditions of your Third Party Account, so it's important to review them carefully before making any purchases.

Once you make a payment to Milna for access to and use of our services, that payment is considered final. This means that all charges are non-refundable, so please make sure you're satisfied with your purchase before completing the transaction.

7.Liability

To the fullest extent permitted by applicable law, the Milna shall not be liable to you or any third party for: (a) any special, indirect, incidental, punitive, exemplary, or consequential damages, including but not limited to loss of profits, data, goodwill, legal or expert fees, substitute service costs, lost opportunities, or other related expenses, arising from your reliance on or use of the Service; (b) any actions or conduct of third parties, including other users or external site operators.

You agree to release, discharge, defend, indemnify, and hold harmless Milna and its affiliates, subsidiaries, directors, officers, agents, contractors, partners, and employees from any loss, liability, claim, demand, damages, costs, and expenses, including reasonable attorney’s fees, resulting from:

● Your use or misuse of the Service

● Any violation of these Terms

● Breach of your representations, warranties, and covenants

● Infringement of third-party rights, including but not limited to copyright, property, or privacy rights

● Claims related to user submissions causing harm to third parties

● User Content or Content shared via the Service

Nevertheless, under no circumstances shall the total liability of the Milna Parties exceed the amount you have paid to Milna for products or services acquired through the Service in the six (6) months immediately prior to the claim. These limitations shall apply even if the specified remedy fails to fulfill its intended purpose. In jurisdictions where certain exclusions or limitations are not permitted, such exclusions or limitations may not apply to you. In those instances, Milna's liability will be confined to the maximum extent permitted by applicable law.

You and Milna agree that any claims arising from or in connection with the Services must be brought within one (1) year from the date the cause of action accrues. Failure to do so will result in the claim being permanently barred.

8.Termination

8.1 Termination by You

You have the right to terminate your use of the App and/or Services at any time by deleting your account. This allows you to stop using the platform and remove your access to all features and content associated with your account.

8.2 Termination by us

Without limiting any other available remedies, we may immediately limit, suspend, discontinue, or terminate these Terms, your account, and/or your access to all or part of the App and/or Services, with or without notice, if we reasonably believe that you:


In the event of account termination, whether initiated by you or by us, your right to access and use the Service will immediately cease. Any Premium Services you subscribed to will be canceled, and any paid Content in your account will be deleted. You will not be entitled to a refund for any paid Content or Premium Services prior to account termination.

If you have subscribed to any Premium Services or paid Content, you are solely responsible for terminating any payment obligations with the relevant Application Store or payment processor related to those services or content.
